THIS IS A LEGAL AND BINDING ELECTRONIC CONTRACT! Please read this agreement carefully before signing and filling in the necessary blanks. You must sign below to complete contract or it is considered null and void. Pay very close attention to high lighted areas. Make a copy for yourself then return it signed with deposit/payment. Puppies must be 6 weeks old for pick-up at kennel or 8 weeks old for shipping.

US Postal Money Orders are welcome for payment.
Due to the latest Internet fraud schemes WE NO LONGER CAN ACCEPT CASHIERS CHECKS. Please read Paragraph 7 for personal check payment information.

This Purchase Agreement is for Serious Buyers only! DO NOT.... submit this agreement unless you have read all the details in full and agree to complete your purchase by 8 weeks of age of said puppy. We will not tolerate deception. Others may be waiting IN LINE to purchase the puppy you have ALREADY CHOSEN. We will not tolerate the holding of a puppy by deposit just so that others cannot purchase it. if you do not fully intend on fulfilling this CONTRACT agreement, please do not sign it. you will be wasting both our time and yours.

This is a CONTRACT! This agreement is legal in all US states and will be governed by the laws of the state of Arkansas for ANY legal matters regarding this contract agreement.

(Paragraph 1) This agreement is effective on the date it is signed and mailed, submitted electronically (according to dated email) to Mikayla Kennels or filled out at time of purchase, which in either case is considered the time of the beginning of purchase of said puppy and date on AKC registration. In this agreement 6 weeks old is considered 6 week age of puppy according to said puppy's born date. 8 weeks old is considered 8 week age of puppy according to said puppy's born date. Puppies must be 6 weeks old for pick-up at kennel or 8 weeks old for shipping.* By signing this agreement the said purchaser is responsible for the completion of sale, including any shipping costs.

(Paragraph 2) The said breeder, agrees not to knowingly sell an unsound or unhealthy puppy to said purchaser. Purchaser must agree to a vet check of said puppy up on arrival within 48 hours or guarantee is void. Date above is considered the purchase date (the date you mail this agreement) for the price agreed upon including any shipping, crate, and health certificate charges. Purchaser also agrees to pay all shipping charges involved and the cost of shipping crate and the cost of health certificate signed by a certified Veterinarian unless purchaser is picking up said puppy at kennel premises. Breeder is not responsible for shipping, crate and health certificate charges at any time. Purchaser agrees to complete purchase by the 8th week of age of said puppy or lose purchasing privileges, deposit and all monies paid toward puppy unless arrangements have been made between the said Purchaser and said Breeder. All deposits will be subtracted from balance.

(Paragraph 3) Breeder agrees to sell the puppy to said purchaser with *FULL REGISTRATION for a breeder at the price agreed upon for breeding purposes or a *LIMITED REGISTRATION for pet/companion at the price agreed upon which is normally lower than the cost for a breeder depending on option discussed with said breeder at time of purchase. In the event breeder agrees to sell puppy for pet/companion to said purchaser with a *LIMITED REGISTRATION, purchaser agrees that puppy will not be used for breeding purposes and is very much encouraged by said breeder to spay/neuter said puppy at the earliest possible age according to guidelines and ages by said purchasers Veterinarian. If the said puppy has been sold as breeder with a *FULL REGISTRATION to be used for breeding purposes, purchaser agrees to study breeding puppies in length, learning correct breeding practices before attempting to breed said puppy at which time said puppy must be a good breeding age as determined by qualified breeding practices. Purchaser agrees that all breedings with said puppy at breeding age, will be done with dogs of equal quality and pedigrees to help secure the integrity of the breed. Purchaser also agrees to take full responsibility of any and all puppies produced by said puppy and will make every effort to find qualified homes for all puppies produced even in case of accidental breedings. (Mikayla Kennels believes in taking responsibility for all breedings and that those involved with the breeding of dogs should be responsible to find suitable homes for their puppies). (That does not mean a pet shelter or adoption agency). Failure to abide by this agreement may disqualify said purchaser of any future purchases of puppies from Mikayla Kennels.

(Paragraph 4) Purchaser agrees also to fully comply with guarantee which states that said puppy must be checked by a certified Veterinarian within 48 hours of purchase and/or arrival of shipping other wise guarantee is null and void. In order to apply the health guarantee the buyer must contact us within said time if any health deficiency was discovered and provide written documentation from two licensed veterinarians of the health issue. All veterinary charges will be the buyer’s responsibility and absolutely no refunds will be given for veterinary services. In the event of genetic related problems that are life threatening, purchaser may ask for a replacement puppy. This must be verified by a certified licensed vet. All shipping costs and/or travel fees will be the Purchasers responsibility.

(Paragraph 5) Breeder agrees to choose to the best of their ability the coat color, traits, and quality that the purchaser desires as best we can. However, we do not sell Siberian Huskies according to eye color. The breeder also agrees that once an agreement has began, signified by a deposit, partial payment or full payment, breeder will assume the said puppy is to be sold to said purchaser and will in no wise sign an agreement of purchase to any other parties even if a higher offer has been made. Breeder will allow a maximum of 7 days for monies or deposits to arrive while holding said puppy. After 7 days said puppy becomes available once again.

(Paragraph 6) Purchaser agrees to assume responsibility to complete the purchase of said puppy they have chosen and may not change their mind in the during terms of this agreement. Said purchaser will notify Mikayla Kennels the exact date deposit is being mailed or submitted electronically. Mikayla Kennels will agree to hold said puppy for a maximum of 7 days allowing time for deposit to arrive by mail, unless arrangements have been made otherwise. In the case the deposit does not arrive in allowed 7 days Mikayla Kennels reserves the right to make available once again said puppy. Said purchaser also agrees that if they have submitted a deposit, they will follow through with purchasing intentions or lose all money that has been paid in its entirely. Purchaser agrees to pay in full the entire amount of the purchase price including all shipping costs if shipping is to be used for said puppy no later than 7 weeks of age of said puppy or lose deposit and all money paid plus purchasing rights of said puppy.

(Paragraph 7) Payments for shipping will be paid to said breeder in full, prior to shipping including cost for a medium crate, health certificate and air line ticket by a US Postal Money Order or Personal Check according to paragraph 7 ( NO CASHIERS CHECKS) according to price quoted by said breeder. If a delay of shipping is needed on the part of the said purchaser and a health certificate has already been acquired, the purchaser agrees to pay extra ($30.00) for a new health certificate via US Postal Money Order ( NO CASHIERS CHECKS) prior to shipping, to said breeder. It is not the responsibility of the breeder to carry the cost of a new health certificate due to delay in shipping because of weather. Said breeder will make every effort to wait until the best possible shipping time according to weather before acquiring the health certificate that is good for only 10 days. All money for puppy and shipping costs must be paid in full by purchaser via money order or cashiers check at least one week prior to shipping ( 7 week age of puppy) to said breeder. We prefer not to ship after 9 weeks of age due to the cost and size of crate necessary. Failure to ship puppies by 9 weeks may result in lost of said monies paid toward puppy unless agreed upon by Purchaser and Breeder. Please talk with us about shipping if you need more information.

(Paragraph 8) Said Purchaser also agrees to pay the full and total cost of puppy, shipping, crate and health certificate at least one week (7 week age of puppy) prior to shipping date. We encourage Postal Money Orders for payments. Personal checks will only be accepted for early deposits and early payment within two weeks of shipping. If you have question about payment options please email us. If you send a personal check just before shipping time, we will mail it back to you and you are subject to lose deposit and your puppy! Full payments must be made for puppy no later than 7 weeks of age of the said puppy unless arrangements have been made between the Purchaser and the Breeder, or you lose deposit and purchasing privileges. Please note--it is not the responsibility of Mikayla Kennels to contact you the purchaser, for final payment or shipping information. It is your responsibility to give us a working email address or phone number for contact purposes. Failure to do so will result in termination of contract. If your ISP blocks suspicious emails as spam and you suspect our emails may get deleted creating contact problems, you should consider simply calling us on the phone for all arrangements. Failure to show interest in fulfilling your contract and/or submitting all payments will be considered breech of contract after 7 weeks of age of said puppy unless an agreement has been made between said breeder and purchaser. Failure to show interest by way of contact and/or payment to fulfill contract will result in loss of all monies, deposits, payments paid toward said puppy. If more payment time is need, please discuss this with Mikayla Kennels before money is lost.

NOTE: We do not sell our puppies based on eye color, period. Eye color of the Siberian Husky is naturally brown, blue, bi-eyed or party eye (split eye). This is not a defect. All colors of eyes are acceptable in this breed. If blue eye are what you want try another breed. If you have an questions regarding eye color please read the Official AKC Siberian Husky Standard located on our website, or you may visit the AKC official website for the Siberian Husky General Description. You will find it is very common among show Siberian Huskies to see brown eyes or bi-eyes. Quality Siberian Kennels do not breed for specific eye color.

(Paragraph 9) Purchaser also agrees to give said puppy a nice loving home, free from harm and agrees to make regular visits to their Veterinarian, keeping the puppy on vaccination and de-worming programs necessary for good health. In the event said purchaser cannot keep said puppy, purchaser agrees to find a qualified home for said puppy and that home not being a pet shelter or adoption center. This contract you are making is not only between Mikayla Kennels and you but between you and the puppy. These are the terms of agreement for both said purchaser, said kennel and said puppy. Electronic Signature and electronic date and specified deposit or payment will execute agreement. Purchaser must submit contract electronically and mail payment or deposit if they agree with terms. You must contact us via email or phone that you have mailed your deposit or monies and submitted electronic Agreement for said purchase. Do not take for granted that you have purchased a puppy if you do not contact Mikayla Kennels at the time of mailing purchase agreement and deposit and/or payment. Remember we only allow 7 days for deposits to arrive when holding a puppy for you. We treat every one fair and equal and we will not sell your puppy while waiting on your deposit if you have committed to the purchase with contacting you.

(Paragraph 10) Mikayla Kennels reserves the right to refuse all sales if the said Purchaser mails a deposit to hold a puppy then cancels or does not try to contact us or make arrangements for full payment. ( We have had instances when folks send a deposit to hold a puppy then when it comes time to ship, we have not received full payment or heard from them. This demonstrates a lack of interest and without responsibility, therefore we will constitute breech of contract. This also puts us in a predicament for we may have already had buyers for the puppies. Using a deposit to hold a puppy then canceling the arrangement when the pup is older is grounds for cancellation and all future purchases.) Deposits and/or monies paid "will not" be returned once Purchase Agreement has been signed. Deposits and full payments are considered the initialing of your purchase agreement. Deposits paid for unborn puppies may be moved to later litters so long as this option has been discussed with breeder. Once puppy has been chosen deposit stands for that puppy.

(Paragraph 11) Mikayla Kennels normal shipping temperature is between 20 and 85 degrees according to www.weather.com and the air lines. With Continental Airlines we now can ship in summer months. Winter restrictions may apply.

Registration Options Defined
* FULL REGISTRATION - This registration means you have full breeding rights with your puppy. It is necessary if purchasing for the purpose of breeding with the right to register the off-spring according to AKC regulations. Full registration is also needed for show. We may allow this registration for qualified breeders. Option must be agreed upon by Mikayla Kennels before submission of contract.

* LIMITED REGISTRATION - Simply means that the puppy you purchase is fully registered, but it's off-spring cannot be registered and cannot enter AKC show events. This selection is for purchasers who will have the puppy spayed/neutered and are purchasing for pet/companion. Option must be agreed upon by Mikayla Kennels before submission of contract.
